In compliance with the provisions of Article 10 of Law 34/2002 of 11 July, on services of the information society and e-commerce, we provide the necessary data of the owner of the website www.zeus.vision (hereinafter the “Website”) service provider:

2. General conditions of use

The present general conditions of use and navigation (from now on, the “Conditions”), have the objective of regulating the relationship between the owner of the web page, as the provider of the service, and the users who access, navigate and enjoy the service offered (from now on, referred to individually as the “User” or collectively as the “Users”).

The Website provides Users with general information about SMART VISUAL DATA products and services (hereinafter, the “Content”), all in accordance with these Conditions.

If the user continues to browse and use the services we offer through our Website, he or she accepts without reservation of any kind, the present Conditions of Use.

The owner of the Website reserves the right to modify these Conditions at any time and at its sole discretion, so we advise the User to review them frequently.

3. General Conditions of Use

Access to most of the contents of the Website is completely free and does not require prior registration, without prejudice to the fact that there may be particular sections or services that require prior registration, and where appropriate may involve the payment of economic amounts, of which the user will be informed in advance, and must accept the corresponding terms of contract.

The user must be over eighteen (18) years old. Access to the website by minors is prohibited. However, in case of access to the Website by a minor, it will be presumed that such access has been made with prior and express authorization of his/her parents, guardians or legal representatives, without prejudice to the fact that the Provider reserves the right to make as many checks as it deems appropriate.

Under no circumstances will the Provider be responsible for the veracity of the registration data provided by the users, so that each of them will be the only one responsible for the possible consequences, errors and failures that may arise from the lack of quality of the data.

4. Intellectual and industrial property

4.1 Legal protection of content

The holder of the Web Page is also the holder of the rights of exploitation of intellectual and industrial property of the Web Page including all the Contents and elements of the same one (to title enunciative, texts, images, audio and videos) available from the Web Page, as well as of which it has lodged in sites of third either because they are of his property, or because it has obtained the opportune rights for his use. Likewise, the owner has obtained the appropriate authorizations relating to image rights of those who appear on its Web page.

The total or partial reproduction copy, or distribution of the Content is prohibited without the express authorization of the owner. In no case will it be understood that the access and navigation of the User, implies a resignation, transmission, license or total or partial cession of these rights on the part of the holder of the Web page. Likewise, it is prohibited to modify, copy, reuse, exploit, reproduce, publicy communicate, transmit, use, treat or distribute in any way all or part of the Content and elements of the Web Page for public or commercial purposes, without the express written authorization of the owner of the Web Page.

Therefore, in accordance with the previous paragraph, the User may, in addition to viewing the Contents and elements of the Web Page, make prints, copies or downloads of them provided that such actions are directed solely to their personal and private use.

It is also forbidden to use the owner’s contact details (postal address, e-mail address) to send any type of commercial communication, unless the necessary authorizations have been previously obtained in accordance with the applicable regulations.

4.2 Associated trademarks and logos

The trademarks incorporated in the Web Page belong to their owner or to third parties, with their authorization for their use in the Web Page.

Those who navigate the Web Page are prohibited from using said trademarks, logos and distinctive signs without the authorization of the owner or license to use them.

5. Responsabilities

5.1 Suspension of the Website

The operation of the Website is supported by servers of service providers, connected through public and private communication infrastructures..

The owner of the Web Page will do everything possible to guarantee the correct functioning of the same, however, it cannot guarantee the absence of interruptions for technical reasons in order to carry out repair work, and/or maintenance or lack of coverage or failures in the equipment and/or networks necessary for data transmission, which are beyond its control.

Thus, access to the Website may be suspended for reasons of force majeure (unforeseeable causes or causes which, whether foreseen or foreseeable, are unavoidable) as expressed below by way of example, but not limitation:

  1. Failures in the electrical or telephone network supply,
  2. Virus attacks to the servers that support the Web Page,
  3. User errors in accessing the Website,
  4. Fires, floods, earthquakes or other natural events,
  5. Strikes or labor conflicts,
  6. Warlike conflicts or other situations of force majeure.

The owner of the Web Page is exonerated from any responsibility if any of the circumstances indicated in this stipulation were to materialize.

5.2 Responsability of the user

The User will use the Website at his own risk. By accessing it, the User agrees to use it in accordance with the applicable legislation and ethical codes, as well as the conditions contained in these Terms of Use.

The breach of any of the norms included in these Conditions or of the legislation in which the same ones are protected, will give place to the responsibility of the User opposite to the holder of the Web page and/or opposite to third, for any damage or prejudice that could be caused as consequence of the above mentioned breach, independently of if it implies the materialization of an illicit one, an administrative sanction, a fault or a crime and will give right to the holder of the Web page to, in his case, to demand his responsibility in the civil, administrative, labor or penal area that could correspond.

5.3 Responsability of the holder

The owner of the Web Page is not responsible for any damage caused to the User or third parties as a result of a breach attributable to the User, nor for the alteration of the User’s equipment.

Also, it does not assume any responsibility by means of illegal interferences by means of the use of computer science virus or another one that is its origin, the illegal use of the Web Page on the part of the User nor errors of security motivated by the incorrect operation of the terminal equipment used by the User.

6. Obligations of the user

The User may not, at any time, modify, alter or delete any data, information, content or element or content that is included on the Website.

The User must use the services made available to him/her in a diligent, correct and lawful manner. Not being able, under any concept, to spread contents or propaganda of racist, pornographic, xenophobic character or that in general makes apology of criminal, violent or denigrating acts for the people and the fundamental rights.

The User may not include software, viruses, malware or any other agent harmful to computer systems that may damage or alter the devices or terminals of the company or other Users.

The User will be the only responsible for the damages that could be caused by not fulfilling the conditions and obligations exposed in the present Conditions.

The User is prohibited from transmitting, including or disseminating advertising of itself or others through any means available on our Website, if it has not obtained the express permission of the owner of it.

7. Hyperlinks

The mentions that may be made in the Web Page to other third-party websites, will have a mere informative character. The owner of the Web Page does not develop or administer these pages nor is he the owner of the Internet addresses mentioned unless this is expressly indicated. Therefore, he will not be responsible for the contents that they incorporate, nor for the damages derived from such access, nor for those generated by the services they provide.

The owner of the Website authorizes the establishment of links and hyperlinks from other websites. However, anyone who intends to establish a link between their website and the Website shall do so in compliance with the following conditions:

  1. The web page in which the link is established shall not contain information or content that is illicit, contrary to morality, good customs, public order or any rights of third parties.
  2. It shall not be stated or given to understand that the owner of the Web Page has expressly authorized the link or has previously supervised, assumed or recommended in any way the services offered or made available on the website that establishes the link with the Web Page. It is therefore recommended that anyone surfing the Web Page should exercise caution in assessing and using the information, content and services available on the linked sites.
  3. The establishment of the link does not imply, in any case, the existence of a relationship between the owner of the Web Page and the owner of the website in which the link is incorporated.

8. Protection of personal data

The owner of the Website undertakes to treat the User’s personal data in accordance with the provisions of current legislation on the subject. Specifically, it undertakes to apply the provisions of the.O. 3/2018, 5 of December, of Protection of Personal Data and Guarantee of Digital Rights and in the General Regulation of Data Protection 679/2016 of 27 April 2016.

9. Applicable Legislation

Those relations established between the User and the owner of the Web Page, will be governed by the provisions of the legislation in force in relation to the applicable regulations and the competent jurisdiction, being applicable the rules of the Spanish Legal System.

For those cases in which it is possible to submit voluntarily to a specific jurisdiction, the owner of the Web Page and the User, with express waiver of any other jurisdiction, will submit to the Courts and Tribunals of the city of Valencia, unless the legislation establishes otherwise.
